Representing the client’s interests in the FAS of Russia with a potential risk of litigation. Due to the specifics of the relationship between vendors and retailers in the Russian market, regulatory authorities closely monitor the communication and legal relations between them. In 2016–2017, the FAS of Russia initiated a case on violation of antimonopoly legislation. As part of the consideration of this case, the FAS sent numerous requests for documentation and information related to the Apple group of companies to Media-Markt-Saturn LLC and some other retailers (Megafon, M.Video, re.Store, Euroset’, Eldorado), without indicating the essence of violation and supposed guilty party. NEF carries out risk assessment and written communication with the FAS, and also takes part in the consideration of the case in the FAS. Consideration of this case may lead to challenging the decision of the FAS of Russia in court.
