The Client contacted a notary to formalize the inheritance of his deceased great-aunt (an apartment in Moscow) in April 2014. The notary refused to formalize the inheritance due to the lack of documents confirming the family relationship. The Client filed a corresponding application with the Tagansky District Court of Moscow. In June 2014, the court agreed with the position of the Department of Housing Policy and Housing Stock of Moscow and left without consideration the Client’s application to establish the fact of family relations on the grounds of the existence of a dispute over the right and the need to resolve the dispute in the order of claim proceedings. The Client’s representative did not challenge the сourt’s decision, and the Client regarded this act as a refusal to fulfill the order.

The Client contacted NEF three months after the court’s refusal, when the appeal period (15 days) had expired. The situation required a prompt action.

NEF, having studied the situation and the case materials, prepared the necessary procedural documents, and submitted them to the court. The court’s decision was overturned by the appellate court as illegal. Subsequently, the court granted the Client’s application, and the family relationship was established. The Client entered the rights of inheritance. Following appeals of the court decision by the interested party (the Department) had no result. The court decision in November 2016 was upheld.
